Typically, a custody case in Riverside will be about joint, primary, physical, or legal custody.  Each of these refers to a different relationship with the child. Physical custody refers to where the child lives on a day-to-day basis while legal custody is the right to make decisions regarding the child’s health, safety, and education.
Unless there is evidence of abuse, neglect or other harm to the child, both parents will likely be granted equal rights to physical and legal custody. This would be referred to as joint custody because both parents have the child 50% of the time.
In an instance where one parent has the child over 50% of the time, that parent is referred to as having primary custody.  A parent that has the child less than 50% of the time would seek visitation rights, which are usually granted unless it would harm the child.
