Can I Change Jobs During My Divorce Case?

Your income is a main factor when calculating child support and spousal support. Thus, if you start a new job with an increased salary, this may impact child support and spousal support payments. If child support or spousal support was already ordered in your case, your increased salary could cause a change in the amount that you are to pay or receive per month. If child and spousal support were not originally ordered in your case, than this income change could provide an opportunity for your spouse to seek such an order from the court.

Conversely, if you start a new job where your salary is less than what you made at your previous job, it could also have the effect of lowering or stopping your child and spousal support obligations.

Switching jobs could also have another effect on your divorce. If your new job requires a change in your regular work schedule, this could affect the amount of child custody and visitation you receive with your child.

It is important to note that changing jobs does not automatically mean that the court will make changes to your custody or child support orders. First, one or both of the parties must inform the court of your job change and request specific modifications to the court order. The court will then provide an opportunity to hear arguments from both sides before deciding if the requested modification will be ordered.

  1. It’s interesting to me that the decision on whether to call a divorce lawyer can be so difficult for people. Obviously, it’s a good idea, especially if it’s your first time. A friend of mine is having a hard time choosing, but luckily she’s got some great support from family. Thanks for sharing!

  2. Definitely don’t forget to notify about a salary change if you start making less money. It would really suck to have to keep paying child support that you can’t afford anymore. Yes, it draws out the time it takes to settle your case and might add to your legal fees, but be fair to yourself and don’t just accept that you’ll have to pay more because you want to get the divorce over and done with!
