First, the court fees and costs may be rather expensive. The filing fees vary in each County, but you can expect them to be between $200 – $300. Also, each county requires that you pay an additional amount of money for investigation costs. This also varies in each county, but usually is an amount over $1000. However, do not be discouraged by these court fees and costs. If you qualify for a fee waiver, you will not have to pay either the initial filing fee or the additional investigation costs!
Next, you must make sure that you have all of the necessary forms. Due to the high volume of forms, it can be extremely frustrating when trying to figure out which forms need to filed. However, you must get this squared away before filing your petition.
Also, you must serve all relevant documents on and/or give proper notice of any upcoming hearing to all the required parties. This includes all relevant family members who have a right to such notice (i.e. parents, maternal grandparents, paternal grandparents, etc.), as well as state agencies (i.e. department of child support services, etc.) This may also prove to be a daunting task, but it must be properly done in order for you to have a chance of having your guardianship petition granted.
