1. What issues does a divorce address?
Family Code § 2010 addresses what a divorce proceeding covers. It states that in a proceeding for dissolution of marriage, for nullity of marriage, or for legal separation of the parties, the court has jurisdiction to inquire into and render any judgment and make orders that are appropriate concerning the following:
(a) The status of the marriage,
(b) The custody of minor children of the marriage,
(c) The support of children for whom support may be ordered, including children
born after the filing of the initial petition or the final decree of dissolution,
(d) The support of either party,
(e) The settlement of the property rights of the parties, and
(f) The award of attorney’s fees and costs.
2. How long do I have to respond to a petition for dissolution of marriage?
Family Code § 2020 addresses how long one has to respond to a petition for dissolution of marriage. It states, “A responsive pleading, if any, shall be filed and a copy served on the petitioner within 30 days of the date of the service on the respondent of a copy of the petition and summons.”
3. Do I have to include my Social Security Number on any forms or documents?
Family Code § 2024.5 address this issue. It states that either party may “redact any social security number from any pleading, attachment, document, or other written material filed with the court pursuant to a petition for dissolution of marriage, nullity of marriage, or legal separation.”
