We get calls from parents who are still being asked to pay child support for their children, even though the children are now all grown up. They wonder how this could be. Well, the answer is simple. If a parent has not been current on the amount of child support that they were required to pay, they are liable for this amount until it is paid in full. Plus, they must pay the additional interest and/or arrears that will get tacked on each month.

Under Family Code Section 291(a), 4502, 4503, and 17400(e), child support judgments, “including judgments for arrearages, are enforceable until paid in full and not withstanding that the child has reached age 18.” Thus, a parent must pay child support until it is completely paid in full, regardless of the age of his/her child. Moreover, a parent’s child support obligation can increase a great deal even after his/her child reaches adulthood, due to the arrearages.
