When parents are determining child custody after a separation or a divorce, it is important to know the different types of custody. There are two types of custody the parents must determine in a child custody dispute: 1) Physical custody; 2) Legal custody.

Physical custody refers to the actual time a parent is with a child. The parents must determine when each parent will be with the child. The time with the child will include day-to-day care, overnights, weekends, holidays, etc.

Legal custody refers to the decisions that need to be made with the child. The types of decisions include where the child goes to school, daycare, religion, medical and dental care, emergency care, etc.

In a child custody dispute, before the parents are called into a court proceeding, the parents must attend mediation to try to come to an agreement over child custody. The parents are encouraged to work together and decide on a plan that is in the best interest of the child. If they cannot come to an agreement, the court will make the determination on child custody.
