In the world of divorcing parties one parent may elect to separate and leave the family home and the children to maintain peace. In California, family law courts do not consider whether one parent has left the home and children so long as there is no evidence of abandonment by the leaving parent. However, If the parent that leaves seeks to obtain custody of the children in the future, it could be a hindrance in that parent’s action to pursue custody.
It could send also send a message to mediation and the court that the other parent is suitable to have custody of the children by leaving the children with the other parent in the home. Also the courts will not want to disrupt the children’s regular routines if they are currently attending the school they are in and the activities they are a part of in that community.

If a parent must leave the family home and seeks custody of the children, then as quickly as possible, that parent should file in family court for temporary custody without hesitation.
