“DVPA” stands for Domestic Violence Prevention Act. The DVPA is intended to prevent the repetition of acts or domestic violence and offer a separation between the parties involved for a period of time sufficient to allow them to seek a resolution of the causes of violence. Specifically, the DVPA is intended to remedy abuse in a domestic situation.

 

Under California Family Code Section 6218, domestic violence protective orders include any or all of the following:

  • Molesting;
  • Attacking;
  • Striking;
  • Stalking;
  • Threatening;
  • Sexually assaulting;
  • Battering;
  • Harassing;
  • Telephoning, including but not limited to, annoying telephone calls as described in Section 653m of the Penal Code;
  • Destroying personal property;
  • Contacting, either directly or indirectly, by mail or otherwise;
  • Coming within a specified distance of; and
  • Disturbing the peace of the other party.

 

Additionally, on a showing of good cause, the court my order the protected person exclusive care, possession, or control of any animal owned, kept or held by either party or a minor child residing in either party’s residence or household. Therefore, the restrained person is prohibited from taking, transferring, concealing, molesting, attacking, striking, threatening, harming, or otherwise disposing of the animal. [Family Code Sections 6218(a), 6320(b) and 6340(a)]

 

It is important to note, that the trial court’s discretion in DVPA matters is more liberal than its discretion to restrain civil harassment generally under California Code of Civil Procedure Section 527.6.
