A guardianship in San Bernardino is a legal relationship where an individual assumes the legal and physical responsibilities of a minor child. A guardian will have both physical and legal custody over the child and will be responsible for the child’s education, safety, and well-being.
A guardian is typically not a birth parent of the child, but an adult that is willing to assume these responsibilities.  A court in San Bernardino will appoint a guardian when a minor child’s parents have become unable to care for the child.
Common reasons for appointing a guardian include, but are not limited to:
• The parents are deceased.
• The parents are unfit because of a legal ruling.
• The parents are incapacitated or incarcerated.
• There is evidence of abuse or neglect of the child.
While appointing a guardian over the minor is most common, you can also seek a guardianship to manage a minor’s estate.  However, this typically is not necessary unless the child has assets or income.
When determining whether or not to appoint a guardian, the court will focus on what is in the best interest for the child. Our attorneys at Wallin & Klarich understand that sometimes, parents can disagree with each other and the court about what is in the best interest for their child. This makes seeking a guardianship a very emotional time for the family.
You must seek an attorney that is familiar and experienced with San Bernardino guardianship law, while being sensitive to what you and your family are going through.
