Many factors come into play when the courts decide the issue of child custody cases in court. Some of the more common reasons a parent loses custody of a child include child abuse, substance abuse by a parent of either alcohol or drugs, mental and emotional abuse by a parent. Even the arrest and incarceration of a parent could be a factor in the court deciding against a parent’s request to have custody of a child.

Of course many other factors come into play which also include a dependency action by social services removing a child from the home of a parent and the courts ordering custody over to the other biological parent.

Among other things, perpetrated proof and a history of domestic violence and and convictions by a parent can certainly be considered by the court in deciding against that parent seeking custody of a child.
Child custody is only one of many issues involved when parties go through the divorce process or even in non marital relationships where paternity is established. Child support, child care and insurance are some of the other issues that typically arise when there is a dissolution proceeding or an active paternity case.
