Father’s Visitation Orders Obtained in Child’s Best Interest

According to court records, family law attorney Yvette Ochoa managed this feat by showing to the judge that monitored visitation was in the best emotional interest of the child as monitored visitation would help the child smoothly adjust to having his father in his life again.

 

Primary Custody Granted for Happy Mom

After a heavily contested legal battle, the mother gained primary custody of her minor child, allowing the two to reside together in Texas according to court record. The child’s biological father had filed a motion to modify the current custody and visitation orders. If granted, the motion would have prevented the minor child from residing with the client in Texas.

 

Father Granted Custodial Rights after Being Refused Visitation

The father’s attorney filed a motion indicating that the client’s former spouse had taken unilateral parenting actions and refused to let the client see his own children or exercise any custodial rights. What you need to know about Child Custody Matters:

There are several things that you and your child custody attorney must consider before entering into any custody proceeding or agreement. The court will base any order it makes on what is necessary or proper for your child in light of the specific circumstances of your case (Family Code Section 3022). This is often referred to as what is in the best interest of the child.

When determining the best interest of the child, the court’s main concerns are your child’s health, safety and welfare. The court will also take into consideration of your child maintaining frequent and continuing contact with both his or her parents (Family Code Section 3020). In other words, so long as there is no negative impact on the health and well-being of your child, the court will try to ensure that both parents are allowed to play a role in raising your child.

Depending on the legal arguments brought forth by your child custody attorney, the family court may establish a custody arrangement in which:

  • One parent gains sole custody of your child,
  • Both parents receives joint custody of your child,
  • Or neither parent receives custody, thus putting your child in the care of a non-party guardian.

Types of Child Custody

There are two parts to child custody: legal custody and physical custody.  Legal custody refers to the parents having the right and responsibility to make decisions relating to the health, education and welfare of your child. Physical custody refers to where your child will reside and be under supervision of a parent or guardian.

Before any child custody hearing, parents are required to attend mediation to see if they can reach an agreement on their own. Mutual agreements are highly encouraged by the courts. However, in the event that the parents cannot come to a custody arrangement on their own, then the court steps in and the parents’ child custody attorneys try to obtain the best arrangement for their client.

The parent who is awarded custody of your child is referred to as the “Custodial Parent,” while the other parent is referred to as the “Non-custodial Parent.”
