In order to Request a trial, there are forms that must be completed in order to request a trial and information must be provided including the anticipated length of the trial (short cause vs. long cause).  After the court receives this form, the court will send you notice of a Trial Setting Conference.  At this court appearance the courts will set future dates including a mandatory settlement conference and a trial date.  At the mandatory settlement conference both parties and counsel will try to reach a full resolution of all matters pending for trial.  Prior to this hearing the parties each must submit a mandatory settlement conference briefs according to the guidelines of that department.  If the parties are able to reach an agreement the court will accept the agreement and the case will not go to trial.  If the parties are unable to reach an agreement the court will set a trial date.  Once a trial date is set and time is allotted for your case, continuances are disliked by the court.  Prior to the trial, each party must also file a trial brief with exhibits.  There are different requirements for the trial brief than the mandatory settlement conference brief, so it is important to seek a knowledgeable attorney to make sure you meet all of the requirements and assist you in the process.
