The court can grant a domestic violence restraining order that lasts up to five years.  If the restraining order expires and you feel that you still need protection you can ask the court to renew a restraining order, either for another five years or permanently, whether or not there has been any more violence or threats of violence. If there is a need for renewal, you should apply for the renewal before the original order runs out.

If the Restrained Person and Myself Have Settled Our Differences and I no longer feel a need for a restraining order, How can the restraining order be dismissed?

Only a judge can change or cancel a restraining order before its time limit has passed. If you wish to make this request, you will need to complete the proper forms and file them with the court for a judge to review the request for dismissal.

Since there are time restraints on when to renew the restraining order and how to get one dismissed it is important to contact a knowledgeable family law attorney.   Wallin & Klarich has more than 30 years of experience in family law.
