If you believe you are the biological father of a child but you are not named as the father on the birth certificate then you must go to court to establish your parental rights. You do this by retaining a lawyer and file for “paternity” of your child. If the mother “contests” your paternity then you will need to take a court approved paternity and possibly DNA testing. If it is determined you are the biological father of your child you will then need to file an “order to show cause” requesting the court to award your legal and physical custody of your child. When the court grants your request this will mean that you will also have the financial obligations that goes along with being a parent. This means the court may order you to pay child support and provide health and/or dental insurance for your child.
Law enforcement will not step in to help you have visitation with your child until you have taken steps to enforce your legal rights. This is why you need an experienced family law firm fighting for you. If you want to be the lawful father of your child then you must take legal action. Having the court rule in your paternity action that you are the legal father of the child will be the start of the process and can lead to you receiving custody of your child.
