Recently, Kevin Bom, a court mediator working in Victorville, was charged with falsifying records in a Los Angeles County child custody case. Bom and three others are accused of failing to remove Gabriel Fernandez from an abusive environment despite more than 60 complaints of child abuse. Fernandez was just 8 years old when he died from a fractured skull, several pellet gun wounds to his groin and his lung, cigarette burns, and the knocking out of his two front teeth. Fernandez’s mother, Pearl, and her boyfriend are charged with his murder and could face the death penalty if convicted.

After the murder of Fernandez, Bom resigned from his position as a supervisor in L.A. County before he could be fired. He then moved to San Bernardino, where he was hired as a court mediator with the superior court. The court is now investigating how he managed to gain employment without any administrative officials being aware of the investigation in L.A. County.

How Could This Affect My San Bernardino Case?

San Bernardino is known as a “recommending” county, which means that family court judges will generally give greater consideration to the recommendations of a court-appointed mediator when ruling in family law cases. As with other mediators in San Bernardino’s family services, Bom’s recommendations in family law matters were generally accepted by the court in child custody cases. In light of the allegations against Bom, the San Bernardino family court has begun notifying parents whose child custody cases passed through Bom’s office that their cases may need to be reevaluated.

This means that there are potentially hundreds of child custody cases that could be re-opened. In these cases, the court will have to decide whether to accept Bom’s recommendations or overturn the previous ruling.
