Physical Custody

 Physical custody refers to where the child resides on a day-to-day basis.  Under California Family Code section 3007, a parent with primary physical custody would have the child over 50% of the time.  Parents with joint custody would each spend 50% of the time with the child (Cal. Fam. Code §3004).

 A parent that does not have primary custody or has the child less than 50% of the time has a right to visitation, which is typically granted so long as its not harmful to the child.

Legal Custody

Legal custody is the right and responsibility to make decisions concerning your child’s health, safety, or education. Usually, you and the other parent will be given joint legal custody of your children under California Family Code section 3003. You both will have an equal say in where your child goes to school, seeks medical care, and practices religion.

Using California Family Code section 3006, a judge can also award you sole legal custody.  A judge will only do this if granting legal custody to the other parent would be harmful to your child.
